Surviving Spouse

To change a registration into your name after a spouse dies, the DMV does not require that you pay any fees. If the title is in your possession, you must sign and print your name on the back of the title in both the buyer and seller areas. There is no tax owed as long as the vehicle was registered in the deceased spouse's name (not to a business).

This policy applies ONLY to spouses - not to any other deceased family members.

  • If the vehicle is 10 years old or newer, you need to bring the title in the name of the deceased person and the current registration.
  • You will need your insurance information and identification such as your RI license.
  • An original copy of the death certificate is required. The DMV will make a photocopy and give you back the original.
  • Fill out the back of the title, signing the vehicle over to yourself by printing and signing your name in both the buyer and seller areas. Be sure to include the vehicle's current mileage reading.
  • Fill out a TR-1 form pdf and a Tax Exempt card.pdf
